Terms of Service
These terms govern your use of Ocular, the service that keeps a written, searchable record of your business calls. Creating an account means you accept them.
1. The service
Ocular provides you a dedicated phone number, captures the calls you place and receive through it, transcribes them, and produces the written record: summaries, verbatim quoted moments, notes, digests, and answers to your questions over your own history. Features may evolve; we will not remove your access to your own data.
2. Your responsibilities
Recording lawfully is your obligation. You must comply with the laws that apply to recording conversations in your jurisdiction, including the Telecommunications (Interception and Access) Act 1979 (Cth) and applicable state surveillance-devices legislation, and obtain any consent those laws require from call participants. You must not use Ocular to record people where you have no lawful basis to do so.
- Keep your credentials secure; you are responsible for activity under your account.
- Use the service only for lawful business purposes; no abusive, fraudulent, or infringing use of the numbers or the AI features.
- Provide accurate account and billing information.
3. Fees
- Plans are priced in Australian dollars, per person, per month: Starter $145, Professional $495, Enterprise $995 (or $1,500 / $5,100 / $10,200 per person per year, billed yearly).
- Each plan includes a monthly allowance of call minutes per person (300 / 1,200 / 2,500). Minutes beyond the allowance bill at 20¢ / 17.5¢ / 15¢ per minute respectively, itemised on your invoice.
- Monthly plans bill on your subscription anniversary; metered overage is charged with the renewal. Yearly plans bill overage monthly.
- Prices may change with at least 30 days' notice; changes apply from your next renewal.
4. Cancellation
Cancel any time from within the product. Cancellation takes effect at the end of the paid period; the record stays open until then, and your data remains exportable after. We do not refund partial periods except where the law requires. We may suspend or terminate accounts that break these terms, with export access preserved except where the law forbids it.
5. Your data
The record is yours. You own your recordings, transcripts, and the derived material; you grant us the licence needed to process them to provide the service, as described in the Privacy Policy. You can export your complete record at any time, in any billing state.
6. AI output
Ocular's written record is produced with AI. Quoted moments are validated word-for-word against the recording, and summaries pass mechanical checks against the transcript — but transcription and analysis can still contain errors, and speaker attribution may occasionally be imperfect or withheld. The record is an aid to your judgement, not a substitute for it: verify anything you intend to rely on for a significant decision, and use the built-in playback and correction tools when something reads wrong.
7. Availability and liability
We run the service with reasonable skill and care but provide it "as is", without warranty of uninterrupted availability; telephony depends on carriers we do not control. To the extent the law permits, our total liability for any claim arising from the service is limited to the fees you paid in the twelve months before the claim, and neither party is liable for indirect or consequential loss. Nothing in these terms excludes rights you hold under the Australian Consumer Law that cannot be excluded.
8. Changes and governing law
We may update these terms; material changes will be notified by email or in the product at least 14 days before they take effect, and continued use after that is acceptance. These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
